    What rate is your PIP Daily Living? (PIP care)


    I assume your net 553 is now? How much is gross now?

    how much were gross and net before ?

    When did your ESA claim start?

    Are there deductions?

    Are you definitely in the WRAG or was your claim closed having been found fit to work and now you are appealing?


    Just a few calculations based on info so far - it's not making much sense yet

    used to get 153 a fortnight, that is £76.50 a week

    Pension used to be 475, 109.61 a week
    109.61-85 = 24.61
    24.61/2 = 12.30

    102.15-12.30 = 89.85
    = 179.70 a fortnight

    ESA IR WRAG with SDP old rate pension
    =164.60 - 109.61 = 55
    = 110 per fortnight

    ESA IR new rate pension
    164.60 - 127.61 = 37
    = 74 per fortnight.

    Somethings not adding up.

    To get 153 a fortnight with no deductions gross pension would have to be ... £7124
    =593 month

    To get 134 ESA IR would have to include SDP and EDP means you are on enhanced rate PIP Daily Living

    73.10 + 29.05 + 62.45 + 15.90
    180.50 - 109.61 = £141.78 a fortnight...must have deductions of £3.70 a week or something
  • i get £553 a month in my bank pension , i used to get £474 ,i get the highest pip rate ,esa claim started 16 months ago,i am appealing wrag as i was told at the job centre i should be in the support group and cab say i should be ok with the appeal and i have been told a decision will be made before 08/12,i have informed them of my pension increase and am awaiting to see how much less i will be getting and its a worry ,i do have commitments and i live in the country and i even have my groceries delivered , i do not want to give up my car and move into town but its looking like it as things are very tight , my rent for instance is £660 per month and i obviously have heating ,council tax ,a loan repayment from two years ago etc etc so yes i am very concerned,thanks

    Those are net pension figures, I am asking for the gross pension figures.

    There are two kinds of PIP, I am asking what the PIP Daily Living is.
    Just saying "I get the highest pip" does not tell me if you get PIP Daily Living.

    You must have deductions on ESA looks to me like it is council tax £3.70 a week

    Based on the information so far, you will get £98 ESA IR fortnightly on the new pension rate.

    If you don't tell them ASAP you could also get a £50 penalty.

    You can also ask them to reconsider your tax years again from
    the 13th week after your 365 days ran out. It is a now 4 months after they ran out, so they may not backdate it for the last month. You should ask for a call back to confirm this will be looked at .from the 13th week after conts exhaustion. when you phone ask them what your award rates are conts and IR and what deductions you have.

    From what date has the pension increased?
  • yes the deduction is council tax,as for the pip , i really honestly dont know , it said pip daily living allowance and its the high level according to cab who organised it for me , gross is £631 per month ,sorry,i didnt know when the pension increase was till i looked today ,the pension increase was three months ago everything is done by direct debit and whats left goes into a daily spend account which normally runs around £300-500 which is all the money i have ,this pays food,transport,heating,clothes ,any expenses and there is normally a surplus of around under a hundred pounds but its crept up to around three hundred and i thought i was being frugal , how wrong was i, it was a letter saying i was due a pension increase today that prompted me to look into it and now i am really concerned , i have written back immediately with all the details i have to hand , i get pension pay slips but never open them , they are all in a box unopened , i never check the bank as i have just enough to get by and i with the increase in rent etc plus the money i will loose and obviously there will be payback ,i am really concerned as £98 a fortnight will be disasterous on top of everything else and now a fifty pound penalty ,omg

    Ok so you do get PIP Daily Living highest rate, that what I thought.

    Your ESA Conts award based on your gross of 631 will be

    102.15 - pension

    631 = 145.61 per week
    145.61 - 85 = 60.61
    60.61 /2 = 30.30

    102.15 - 30.30 = 71.85

    So your ESA Conts fortnightly will be £143.60 on the new pension rate.
    Assuming WRAG component is allowed on new tax years. (I don't know if it will be, because of the new claim rules for WRAG component)

    You should phone ESA and tell them of your new gross and net pension amounts. And ask for New RITY (tax year) to be looked at from the 13th week after conts exhaustion date (the 365 days exhaustion date)...

    Tell them you want them to send a handover for a call back to discuss this... When you get the call back ask them not to calculate the over payment until they have considered your new tax years from the 13th week. It doesn't really matter anyway as if they do the overpayment first and your tax years second the arrears for the conts will be offset on your overpayment amount...it would just be a cleaner way for them to do it all in one go.
  • Thank you epitome that all makes sense , thing is till just under two years ago i was working and had een so in the same job since leaving school , never had to deal with this kind of thing and then i fell over one day and my knees went and within a few months i was getting joints replaced and practically housebound ,i have had seven operations in two years and have just had part of my stomach removed having weeping blood vessels causing my hemoglobin to drop to 5.5 and my sister finding me flaked out so i have had a torrid couple of years , i dont drink alcohol and dont smoke , no luck really , anyway thanks , i will do these things and i am sure it will pan out , cheers Alan

    Let me know if you are successful to get ESA Conts re-instated on new tax year... (you should be successful) and if it turns out to be £143 per fortnight.

    But also remember in asking for Conts to be reinstated as the poster above said you could make yourself liable for Income Tax.


    I make your taxable income to be £127.61(Pension) + 71.85(ESA C) = £10,372.20 per year Assuming you get Conts reinstated at the rate I said.
    The personal allowance is £11,500

    No that can't be right...why do you have tax taken out of your pension? if you are already above threshold your ESA C will put you further over threshold

    i too cannot thank epitome enough , my fears are now allayed and i may even sleep tonight , the pension tax was an error and has been rebated but still hasnt been rectified despite a phone call ,i will call again monday,thank you again
