I purchased a fridge/freezer from John Lewis In Sept., 2014. The guarantee has run out (just) but the unit has broken down and has been declared "beyond repair." Under the Sale of Goods Act, 1979, I do not feel that the unit has lasted for a reasonable time (expected 5 years minimum) and therfore I have asked for a replacement or a full refund. John Lewis have said no and have simply offered an allowance of £306. Is this fair or am I entitled to a full refund or replacement. The appliance cost £649.

  • Why do you believe you should get a full refund when you have had the use of a fridge/freezer for 38 months?

    Their offer of £306 seems perfectly fair.

    The alternative route is to pay for an independent report highlighting the fridge/freezer is inherently faulty (Which JL could have asked you to do) and take JL to the small claims court - However asking a court for a full refund would see you laughed out by the judge.

    After the first six months you can no longer demand nor expect a full refund. A partial refund is perfectly acceptable and they have offered almost 50% and seem to be basing it on a 6 year lifespan which is incredibly generous as they could have offered a lot less. If as you said they expected it to last just 5 years they would be offering around £240.
  • I think £306 is more than generous after the usage you've had on your current appliance. Snap their hands off.
