Hi All,
Our washing machine (13 months old annoyingly!) has developed a fault.
Who should we be dealing with regarding any rights about fitness for purpose? Is it the manufacturer or the retailer? Both are saying each other!

Your contract is with the retailer but as the goods are over 6 months old the onus is on you to prove the fault is a inherent manufacturing defect, this should be done by way of independent inspection, if found to be faulty then the retailer will need to refund, repair or replace the goods (their choice) and pay for the report.0

A warranty usually comes from the manufacturer. Your legal rights are generally with the retailer/supplier.

As said not the manufacturer .
But a manufacturers warranty may fix the fault for you .0 -
Thanks. It’s developed a crack in door which I don’t feel is expected after just over a year but it’s out of manufacturers warranty now. Neither retailer or manufacturer are willing to send anyone to even look at it as its 13months old. Do I have any way forward other than arranging for a new door and paying for that myself?0

Your other option is to get an independent engineer to write a report stating that it is an inherent fault, then take tha5 to the retailer where they would have to reimburse the cost of the report and offer a solution (repair at their cost, replacement at their cost, or refund which could be partial).
Of course the independent engineer may determine that it is not an inherent fault and then you are out of pocket for the cost of the report too, cracked glass after more than a year is going to be almost impossible to determine as an inherent fault. Anything could have happened in that time to cause it.0
