Are they Legal

I just took out a Swinton Car Insurance on the basis of a £40 promo code
The code failed to work.

Now isn`t this "misrepresentation", they are offering a discount which is impossible to receive
Surely must fall foul of the ASA rules ?

    If you feel misrepresentation then report it to the ASA, it takes a few clicks.

    At what point did you know the promo code failed ? Who offered the promo code ? The way to go is make a complaint to Swinton and if you do not get a satisfactory outcome you can escalate to the FOS, take a look on the Quidco and TopCashback threads for similar cases.

    It only failed to work, once I had got to the point of generating the price

    I cannot find any T&C`s on the Swinton site concerning Promo Codes

    did you contact them at the time that the code did not work?, as it might have just been an error.
