Who has to prove what?

Hi!
I was given a parking ticket by CP Plus at Meadowhall, but the ticket didn't contain an actual explanation of the alleged infringement, stating instead:
Parked in a restricted area.
I sent a message to CP Plus asking if they had evidence to support their claim. I've since had a response, but instead of answering the question:
To enable us to investigate further, we require receipts of purchase covering the date the PCN was issued showing that you were a customer of Meadowhall.
I responded:
The onus is on CP Plus to provide evidence to support their claim, not me to prove otherwise.
Do you have evidence to support your claim?
Who has to prove what?

Yes, that's the gist of it.
But the point here is one of proof, and so far none has been given.
Without evidence there would be nothing to stop them from issuing tickets to anyone.
  • There is a very old legal maxim, so old that it is in Latin: He who accuses must prove.

Most Parking Companies, and, regrettably, a lot of District Judges, appear to have forgotten that.

I agree, this is a scam site, a cash-cow, already discussed on the forum. Did you miss all the other threads about Meadowhall, including the one today?

Let's not go over the same ground. You will learn much more from other threads.

Ask if anything is unclear, and if you do get a claim, then rest assured this forum has a 99% success rate with fully-coached defended cases v any PPCs, where the OP sticks around from defence to hearing.

Read the other threads linked in that earlier one. It includes a POPLA appeal example on one previous thread linked there, and it's easy to win. Also an ICO breach is discussed in the thread by PKandF.

  • Yes, I read up on the advice a while ago, but I've sort of fallen in between things, which is what prompted me to reach out.

Send the NEWBIES thread template BPA appeal anyway, even if 'late'.
