yes i am aware of thatAlmost all will use the power and quite rightly.
There are exemptions for properties in probate – so that deals with the OPs issue – but anyone else who leaves a property empty for more than two years when we have a housing crisis deserves to pay a minor penalty. No different to taxes on other things that are bad for society – like alcohol and tobacco.
my point is that the empty property rate does not apply until after 2 years. A factor that OP did not seem to have picked up. Even then, as CIS now adds more eloquently than I, the care exemption trumps the 2 year period anyway.
OP's post implies that the sale of the property is already under way ("we are selling mum's property") so given the property is already exempt by virtue of mum being in care, it is unlikely that the empty homes premium would ever be triggered at whatever rate between 50 - 100% the respective council may decide to apply under its new powers0
