Tenancy deposit protection - can someone please clarify?

Ok, so how does this work when an AST is renewed? We paid our deposit in 2005, and have not received any information about it from our LL since then, so I highly doubt that he has taken out protection since April.

What happens at the end of the periodic tenancy? Does the LL have to protect the existing deposit if the AST is renewed? And what happens if you move to a periodic contract?

As I explained in another post, we moved to a periodic contract last year (september 2006) but the agents have just asked us to "renew" it for another year. Is it in our interest to do this or not? We have no wish to move at the moment, and in any case the contract contains a 2-month notice clause, so we didn't think it would make much difference either way?

    If you move to a periodic contract, the landlord does not need to protect your deposit. If you sign a new contract, he does have to. If you sign a new agreement, your deposit should be protected.

    Thanks Lavendyr, that's what I thought, but I wasn't sure. I guess we'll sign the new contract after all, since it seems like our rights will be better protected that way.

    Just make sure that your landlord does protect your deposit! Although many landlords will do this as a matter of course, some landlords still don't know about the new legislation, others may conveniently 'forget'. But if your deposit is not protected, you can sue the landlord for 3x the value of the deposit.
