Flat fell through, estate agent have my deposit - can i charge interest?

You can take it to court and actually charge 8% interest - forget what everyone else is saying. However, you have to have asked for it back, sent a letter before action given them 7 days and then pay about £50 to take it to small claims court (which can be added to your claim).
Whether or not you would win is another matter.
My argument if I were the agent would be that it presumably says refunds can take up to 7 (working days if that is the case) and/or that they never signed in the agreement they would pay you interest.
