BMX price wrong

I purchased a bmx last night for £38.99 I know cheap maybe to cheap, anyway I got an email today saying it was cancelled as it was out of stock so I phoned the company and they said no there was a pricing error and to phone the partner company, I did and they said it was out of stock and would issue a refund I don’t want a refund I want the bike for the price I paid!! I’ve found the same bike on other sites sold by the partner company. Where do I stand?? Thanks

  • How much should it have cost?
    If you knew (or should reasonably have known) it was a mistake you will struggle to argue this.

    Mistakes happen and the law provides that nobody should gain or lose from a genuine mistake.
  • No I didn’t know just thought it was an offer on for Black Friday. I don’t know how much I should have cost they didn’t tell me

    If the bike is normally £50-100 you may be able to swing it.

    If the bike should have been £389.99 then you won’t get it.

    You don’t need to be a BMX genius to know bikes aren’t usually £38.99. You tried your luck, as we all would, but the shop has no obligation to sell to you for a pricing mistake.

    The same bike elsewhere should give you a rough guide as to the 'correct' price

    Have you checked their T&Cs? You may find that the contract isn't formed until the goods are actually dispatched and that if it was a mistake they can cancel the order.
