Car Insurance renewal after hit by uninsured driver
Options
Bit of an odd one so bear with me, but my car insurance is due for renewal next month and my insurance company have just thrown me a curveball leaving me a bit confused. The sequence of events are as follows:
Oct 16 - I get rear ended by an uninsured driver at a set of traffic lights. Accident gets reported to my insurer, I pay the excess and they put my car in for repair. MIB proceedings are started at around the same time.
Dec 16 - My insurance is due for renewal. Of course it goes through the roof with the claim still being open and me losing some of my NCD, however I renew with the same company figuring it will be easier to deal with one company instead of two.
Mar-Apr 17 - MIB send me a letter stating that fault is "not in dispute" and reimburse my insurance excess. A bit of back and forth with my insurance company later and they agree to reinstate my NCD and adjust my insurance price.
Today however I’ve just received a renewal quote from my insurance company and on the statement of fact where the accident is recorded; both the “at fault” and “NCD” are marked as yes. I was thinking this should be recorded as “Accident, not at fault, NCD not affected” but I’m now starting to doubt myself. Have I got it right or have the insurance company?

Pick up the phone. You seem to be right on the face of it and it may just be an administrative glitch on their end due to the MIB being the party that paid out. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

It's most likely an underwriting issue eg that they have agreed to allow your no claims bonus even though your Insurer have not recovered their outlay for the claim.
They may mark their records that the accident is at fault and that no claims bonus affected so that their quote system applies the relevant loading for a fault claim.
Insurers regard a claim to be a "fault" claim when they do not recover their outlay.
So even though they have allowed your no claims bonus, they may regard the accident as being your fault. You may also find that any new Insurers regard the accident as being a "fault" claim.
As Tarambour has mentioned, your best answer is to ring your Insurers and ask them what is happening0 -
I managed to get through to them today (had no luck yesterday evening) and the chap said that he still has the claim listed as open. When I explained to him that I received my no claims discount back I was told that the claims team run a different computer system and two don't always sync up.
Net result is that I've forwarded on the email confirmation that my claim has been closed and I've to call back tomorrow so they can liase with someone from the claims team and try and work out what's going on.0
