  • sorry @moogles44, we have searched everywhere , including lofts. If there was anywhere left to search we would :-) , Amongst my mother's important papers, there was only the copy will. She was very fastidious with her paperwork and if she had the original, it would have been there too. Thats what convinced us that the Solicitor last had the original will in his possession.
  • in case it may be of value to others, I wanted to update on our situation which thankfully has had a successfull ending. We were eventually still let down by the original Solicitor so took the advice on here and engaged another solicitor who very quickly and easily submitted the copy Will with a signed Affidavit by the sister (Executor). last Monday 20th February we receive the Grant ! . Given Xmas and other slight delays got in the way , it didnt turn out too long in the end. We may have been able to do it ourselves I guess but felt more reassured having an expert involved and he was very kind enough to keep his costs very reasonable. I am in half mind to lodge a formal complaint about the original Solicitor but just not sure its worth the time and effort . Thanks again everyone for your help. i have a different issue now with the inherited property and my co-beneficiaries but wll open a new thread on that. Thanks!

    Your case may be the tip of an iceberg, and reporting it to the SRA/ombudsman may be enough to trigger an investigation - If this solicitor has lost his moral compass, and others have also lodged complaints, adding yours to the pile may help to protect others in the future.

    If nothing else, you might get compensated for the legal fees you've incurred.

    The OP really should lodge a formal complaint using the solicitor's own internal complaints procedure. They cant make a complaint to the SRA unless they have done that first. As Freebear says it may just be the tip of an iceberg. finding time to write a letter will not take lone or cost much.
