    I suggest you re read the link I posted , someone will be along shortly to give you an email address of a party at the BPA / POPLa to appeal to

    it has been clearly stated that a NON UK address is acceptable , if NCP do not not like this , then tuf , let them argue with the bpa

    POFA 2012 stipulates that a servicable address must be
    given to transfer liability to the driver.

    Nowhere does it say it must be in the UK
    The servicable address must of course be real

    It is tough luck that the operator will not accept a
    foreign address. You have complied with POFA 2012

    As pappa said, let NCP argue this out with the BPA

    You have done your duty as per the law so best
    to see if NCP are stupid enough to go further and if
    they did, you would have a valid claim for costs
    against NCP

    Firstly, they have the address for the keeper which they
    got from the DVLA

    Secondly you have provided the address of the driver

    No point in complicating it further with an email address

    Nothing in POFA about email addresses.

    Either they contact the driver with the address
    you have given or they cancel

    Only two options open to them

    Of course they think differently .... they want money

    A letter to the BPA requesting where within POFA does
    it say overseas addresses are not applicable ?
    It's not there so their reply will be of interest

    POFA 2012 is in many respects a mish mash.
    Government relied on the BPA for advice but seemingly
    never questioned the advice, hence it is a mish mash.

    this is so obviously wrong.... so one course of action is to write to your MP , and explain how you are being hounded by this industry .....

    inform him/her that there is a private members bill going though parliament to help stop such bad behaviour ....

  • I have also today received an email from TRACE Debt Recovery. Unfortunately they're not saying anything apart from referring to the attachment which is the letter from NCP to me requesting an email address for the driver as they are unable to send letters outside the uk.

    This afternoon I sent a reply to BPA pointing out what I've been told on here that the The Protection of Freedoms Act. Schedule 4 Para 5(1)(b) refers only to an address at which documents can be served. It makes no mention that the address must be an email or a UK address.

    Do I have to reply to the Debt Recovery and/or to NCP? I do not want to go to court etc

    I would not reply to DRP or to TRACE RECOVERY either

    its a case of who blinks first on this one

    The POFA2012 makes no mention of the postal address having to be in the UK, nor of providing any email addresses either

    you have discharged your liability so I would not bother with anything else other than an LBC or an MCOL in the post , initiaited by NCP or their solicitors

    well done for contacting the BPA again, they dont know what they are talking about despite their own POPLA ruling on it some time ago

    I would stand my ground , and let a judge decide if it were necessary

    try emailing the BMPA and see if they are interested in helping out on this one

    timewasters and you ignore them, timewasters with
    100% no power .... just leeches trying to extort money

    IGNORE DRP AND TRACE and other idiot debt

    As a tip here .... NCP know there is nothing they can
    do. they are phishing for an email address to find out
    who the ISP is, be it UK or Germany
