do to a quirk in being tuped from another company it works out I've got 3.5 hours holiday owing. if the 3.5 hours gets transferred to next year the same thing will happen. The company say they dont give payments for holiday hours but wouldn't this be the best way to solve the issue
thanks

Cant you just take 3.5 hour and have an early weekend?do to a quirk in being tuped from another company it works out I've got 3.5 hours holiday owing. if the 3.5 hours gets transferred to next year the same thing will happen. Why does the same thing happens if it's transferred to next year? You will just your normal holiday entitlement + the 3.5 hours.
I'm sure it would be nice to have that little extra money before Christmas but if it doesn't have to suit the company and solve anything to them when they don't see any issues.0 -
not that type of job. its a job where cover had to be provided for the whole shift. and not office based
Have you asked your employer how they want to deal with it?
Is it a one off (i.e. will it still be just a total of 3.5 hours if it rolls over to next year or will be be a total of 7 hours next year if this year's is rolled over?)
One option would be to ask them to pay it to you.
another would be to ask them to confirm you can work a part shift presumably they have provisions in place if someone is taken ill part way through a shift which it might be possible to apply if you are only working a partial shift.
A third possibility would be for you to ask to take a full day off and to take the proportion of it not covered by the holiday to be unpaid.
You say they say they don't give payments -who have you asked, and did you explain the specific issue with the 3.5 hours and the fact you work shifts. What is their suggested solution? It may be that it needs a more senior person to over-ride the standard process to allow you to be paid out.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Is the 3.5 hours in addition to the statutory minimum of 28 days? If it's included in the 28 days then it wouldn't be legal for your employer to pay for it, but they would be required to allow you to take it. If it's extra then they can pay you (but don't have to) or should allow you to take it if they won't pay - how that is achieved is, as Comms69 says, the employer's problem not yours.0

because i can't finish any shift early. say I've got 40 hours holiday and i work 8 hour shifts there will always be a mismatch0 -
carry over year to year and it get paid when you leave.0

I don't understant how you can't finish your shift early, all they need to do is pay someone else to come in early to cover your A/L? Use it or lose it is always the advice with holiday entitlement, and how the employer covers your A/L is their problem not yours.because i can't finish any shift early. say I've got 40 hours holiday and i work 8 hour shifts there will always be a mismatch0
