    I was more thinking of your rights towards the house itself, if you'd contributed to the deposit and been a bill/mortgage payer. I'm not entirely sure he can just kick you out without some form of financial settlement.. This is definitely lawyer territory though.     In England or Wales: Whether or not you have made any financial contributions, you might be able to get an ‘occupation order’, but you would need to use a solicitor for this. Just because you’ve contributed towards the mortgage, doesn’t automatically mean you’re entitled to a share in your ex-partner’s property. But you don’t necessarily need to have signed a formal legal document with your ex-partner to claim what’s called a ‘beneficial interest’ in the property.
    Maybe just the threat of this could be enough to help get the cash back. Maybe talk to the Citizens advice bureau?

    Seperately he is not responsible for returning the property, simply allowing it to be collected
  • But the op said she had only been living there for four weeks? Not a great deal of time to be paying mortgages and bills as she advised she did...

  • The issue with the £2700 towards the purchase price of the property would cme under the Trusts of Land and Appointments of Trustees Act 1996.

    Essentially you would have to prove that you paid towards the purchase price in his sole name further to an express agreement between you that the property was to be held in his sole name for the benefit of both of you, and that you relied on this to your detriment. The fact that you only lived there for 4 weeks however would undermine this and lend itself (excuse the pun) to an argument that it was a loan, which you would need to push through the small claims process to try to claim it back.

    Similarly if he refuses to return your belongings thrn you would have to go through the small claims court.

I also sent a screen shot of my bank account clearly transferring the money to him. I got an email asking for proof it was given as a loan. I just replied saying put it in writing. He's reply was "tough"

    I still can't get through to CAB. Think I'm gonna have to take a day off and pay them a visit instead.

    His house and email fine, but his work?! and his mothers house?!


    You need to just stop, quantify your loss and apply via MCOL - though I doubt your letter meets the pre action requirements, can you post a copy here? (removing personal details)

    It's borderline harassment. Pre-action protocol has a clear process.

    I'm not trolling. I'm highlighting inappropriate behaviour. Someone sending mail demanding money to work and family is committing harassment.
