Fence Wall on the boundary.

Hi,

I am in the process of buying a Semi Detached house and would like to build wooden fence on to the side of my house on common walkway.
This common walk way to garage (Tools Garage not driveway -) with right of way mentioned in the deed of my house and my neighbors deed it is mentioned as "provisions of deed of grant of right of way."

I am not sure if I can build wooden fence with wooden door on the boundary and also there is brick wall to the front of the house which I would like to extend to the boundary.

Your help is much appreciated. Not able to post Image links as I am first time to forum.

  • If you're in the process of buying it, ask your conveyancer the question. S/he will be best placed to advise you what is allowed or not permitted and where you may erect a fence, what height it can be and so on. On each of the three occasions I've bought a house, I've had a meeting with my conveyancer where he went through everything and allowed me to ask questions like yours.

    From the sound of it, if it is a shared drive way with "provisions of deed of grant of right of way", you can't build anything there - not even a wooden fence. To what extent is the drive way is shared will be marked in the provisions document.

    Clarify this with your solicitor before jumping into any further conclusions.

  • As magn8p says, if there is a right of way over your land (e.g. a shared driveway), you generally can't do anything that would restrict the right of way for anybody who benefits from such a covenant.

    Assuming its just shared between you and your neighbours, you may be able to get them to agree to the erection of a gate on the basis that it would make whatever it gives you access to more secure and all have a key, but there's no guarantee that they'd agree (and if they did, a future neighbour may not).
