So you're saying his insurance will cover a third party recovering his car?

A third party did not need to recover the car as we already had our own recovery service on its way, until we were told by the police to cancel it and use their own

The police officer said not to worry that any fees would be recoverable through our insurance, and that you could have car taken to a nearby place of our choice. No mention of a compound or miles away

She argued with the recovery driver but he was having none of it

The breakdown happened about 1 mile from our house

Wig, we gave made a complaint to the police. Not sure where it will get us though

We have been advised to get in touch with the Ombudsman and our local MP to see if any of those will help out

The offere was wrong about the insurance, it will not cover recovery following a mechanical defect.

If the driver was having none of it why did you allow him to take it?

You stated that their Insurance won't cover a breakdown, if they had breakdown cover with their Insurance it would have covered the breakdown.

I did not state the breakdown cover would cover the third paties fees.

However there being breakdown cover in place may well help the OP in a complaint to the Police, although it will take a lot of complaining as they will try and brush the OP away to start with

Make 2 complaints, one against the officer, for incorrect information, and unreasonable action. and one against the force for not refunding you the money themselves.

He'll get nowhere with that, 30 minutes is policy and you can't complain about that.

Under what law would the OP have had a choice?

Yes, he has recovery through his insurance but his insurance won't cover him as the police wrongly told him it would.
