Car insurance claim improperly handled
Comments
-
Buy his claim is there way of saying pay us for what we payed him, which is a bit cheeky considering they’ve admitted the whole claim was made in error0

The insurer has agreed with me that I’m not responsible, saying you would BOTH rather deal with it outside of the insurer is not an admission of guilt, if you were a first year driver would you not rather leave the insurance out of it? I’m hoping to get better compensation than £150 and being told to pay them for his claim.
Look through here
http://www.ombudsman-decisions.org.uk/
You'll be hard pushed to find any higher compensation than what you've been offered
As for not going through the insurance, I always would and have, as you have found out the hard way doing it privately doesn't prevent a claim later, Your lucky a personal injury claim wasn't included too!0 -

You have nothing to lose by going to the ombudsman so worth a try, Just don't get your hopes up of anything more substantial than what you have already been offered0

The claim was made on the week of the accident and settled not long after, with no statement of any kind from me and because I didn’t know any claim was going ahead I had no chance to defend myself at the time with security footage. They also never investigated if the damage he said I caused matched up with my damage (it didn’t, they admit that now also). So because of their error I have to enter into all renewals that a £1680 claim was made against me that is completely my fault. Mate when they said that number I told the women on the phone I’m surpiried he didn’t go for whiplash and she agreed!
They have agreed it was made in error over the phone in recorded conversations and are going to agree in writing, they’re literally not disputing anything against them, they’re actually detailing everything that they done wrong in a letter, I didn’t even request them to! Is this not a bit of ammo for the ombudsman?0 -

that's not what you said
He claimed you caused it and you said you would pay,our cars touched briefly causing no damage to my car however the other party claimed I caused a scuff/dent on his.
As I’m a first year driver I wanted to settle this outside of insurance no matter who was at fault0 -

You may well win, But as I say look through that link, they don't really award much more than what you have already been offered.0 -
Cheers for a link I never noticed that on the site, Had a quick look and that £150 is probably the most I would get. I’m more interested in having the claim voided or removed somehow as I don’t understand how it can still be there unchanged when they’ve admitted it’s wrong, do you think that’s a possibility?0

Unfortunately, no one here can say. Impossible to second guess your insurance company or the person handling your complaint.do you think that’s a possibility?0
