Should I bother including the tenancy agreement? It think it makes my case weaker?

No, don't take it. It is the claimant's claim to prove. You might be better pointing to the fact that the Claimant has failed to consider the Head Lease, and ask for an adjournment or for the case to be struck out due to the Claimant riding roughshod over residents, with unconscionable charges.

But surely your brother's case to defend (maybe yours?).

Oh dear. For a multi-ticket case you appear to have dropped the ball so I hope the Judge picks it up again somehow and lobs it back to you.

This one is looking dodgy and you MUST be there on time and stay/return as the Court requires, and you will not be at work for the afternoon.

Take a note of DJ Skelly's words in another case and hope one of the other Judges looks up to DJ Skelly and likes his reasoning about Union Jacks.

I don't see the relevance of DJ Skelly's judgement with mine? That case, from what I understand, was the right to free parking that person enjoyed prior to the parking guys coming in at a later date

Yes it was, but how do you know the evidence the Claimant will bring, and whether your DJ will agree with DJ Skelly that expecting residents to display a permit, per se, is unreasonable at home (and he's a property expert barrister).

Flippin' heck, for this sum of money and having dropped the ball for 8 months then rocked back up here, and given the fact your tenancy agreement doesn't help you and you want to go to work instead of turning up at the Court, what else do you have to save you?!

    It's your case isn't it, not a brother's?

Best of luck, as per the legendary Bruce Springsteen's song, you will be Countin' On a Miracle to win this one.

Who's case is this? If your brother got the 6 tickets, are they after you as Keeper?

If this is a Keeper Liability case / Residential case there are slight differences. Who is the claim against?

No it's my brothers not mine.

Sorry if I sounded ungrateful or rude but I was saying because the car was not parked in a bag. But on a pathway outside the house that's why I stated that it may not be relevant

It's my brothers case. He hasn't admitted he was the driver. I'm only helping him with the case that's it

Is your brother turning up at the court? If he isn't, why are you attending?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I think a more relevant track is A-Ha's Lamb To The Slaughter.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
