New Boiler Just Installed is Faulty

Hi - my daughter had a new Worcester boiler installed yesterday and everything seemed to be going OK but when finished, the gas fitter said it wasn't working. They told my daughter she would have to phone the manufacturer to get someone out to service it. She hasn't paid yet because it's not working but I'm not sure what her course of action should be. Can anyone advise please? Thanks

    I would have expected the gas man who installed it to contact Worcester if there was a problem but it seems that her contacting them might be the easiest way forward. Is the installer on their approved installer list ? https://www.worcester-bosch.co.uk/how-to-buy

    She should contact Worcester they will fix it if it’s a fault on the boiler not on the install, she can then pay.

    Wrong - in my view. The installer is the contracted party not WB.

    If the installer has a problem with the boiler that he has fitted then it is up to him to take it up with WB - not the householder.

    The Supply of Goods and Services Act says that all building work must be carried out with reasonable care and skill, with materials of satisfactory quality that are fit for purpose.

    Agreed. Until everything is fully operational the installer has not completed their work ,Do not pay until everything is working. Any reputable installer will accept this.

    Who supplied the boiler?
    If she supplied it and the man just fitted it, it should be her responsibility to get the issue dealt with as it's not the man's fault/order that it's faulty and he'd not be paid for his time to deal with it.

    If she ordered it through the man, or through his company - and the man turned up with the boiler, then the responsibility should be at his feet to deal with the problem.
  • The installer supplied the boiler - he brought it when he came to fit it yesterday. So I think I agree with you but he told my daughter she should contact Worcester and arrange for them to come out and fix it.

    As PN, if it was to Supply & Fit then the installer has the problem

    What should be happening and what is the easiest way forward (in winter) are not always the same. ;)

    So what happens if the customer calls out WB and they look at the boiler and say that the problem relates to the installation? For example, the new boiler was bolted on to a 'sludged' system which has blocked the filter. That leaves the customer in a contractual 'no man's land'. Better, in my view, to let the two parties fight it out so that the customer retains her legal right to reject the boiler.

    Whether WB will talk to your daughter may depend on if the installer has registered the boiler yet with them.
    When I had mine installed this took a few days to be processed.
    As above let the two contracted parties resolve it between themselves.
