So I can get a third off the ban or fine automatically?
As for hard ship, it would affect me in the sense of not being able to take mail to the sorting office and taking my elderly parents out on the odd trip which I'm sure won't warrant hard ship as they can drive also. I can also get to the hospital for personal checkups etc.
The problem with where I live is it's easy to get around as I live in a town between Manchester, Chester and Liverpool and there's trains and buses easily available.
I just think the prosecutors would tell me to take public transport.0 -

As for hardship, you're not going to get that given what you've posted but I think you knew that already. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

The guidelines suggest a one-third discount from the fine for pleading guilty at the first opportunity.
No discount from the ban, or costs or victim surcharge.0 -

You ain’t really got a case then.0 -

A policeman with a radar caught me doing 35 and so received a FPN a few days later.
I'm surprised that you're not being offered a speed awareness course - unless, in addition to the three offences you've been prosecuted for, you've also completed one within the last three years?
A speed awareness course would remind you that everything but the default limits has to be regularly repeater-signed. The default limits are 30 if there are streetlights, and if no streetlights then 60 on a single carriageway and 70 on a dual. So a quick glance would have told you that the road was a 30... The number of lanes does not affect the limit, ever - the number of carriageways does, but only when it's NSL - signed as (/)I checked earlier on the DVLA site and this is showing the below:
SP30
Penalty points: 3
Offence date: 25 Feb 2017
SP30
Penalty points: 3
Offence date: 2 May 2016
SP30
Penalty points: 3
Offence date: 18 Oct 2014This shows that at the time, I had 9 points but the 3 on the 18th October came off just 6 days after the date of offence.
They are still shown until 18th Oct 2018, and you will still need to declare them to your insurer until 18th Oct 2019.The DVLA site is now showing I only have 6 points, so I guess the 3 expired came off and any for this latest offence are yet to be added?
When your ban has been served, you will be back to zero points for totting-up purposes, but will still need to declare the convictions - including the ban - until five years from their date. The ban will show as TT99. The absolute minimum that the magistrate can possibly impose is six months - unless you can show why you should not be banned.0 -

You get a discount for early guilty plea.
The prosecutors cant tell you anything, but the magistrate might.
It's worth being there in person, and if you need to drive to care for elderly parents, they may decide a ban is not reasonable. BUT that usually means that they will increase the fine (still within guidelines)0 -
The only other case for hardships I can think of is:
I did suffer from Anxiety and Panic attacks and whenever I'm out and no I have a place of refuge, that does help me.
My doctor is also aware of this issue and has prescribed medication which I've been able to stay off for well over a year.
I've also full stopped drinking and smoking over the last 14 months due to a liver condition/slight drinking problem and not having a car may trigger thoughts of starting those up again.
I guess the above are not rules for hardship but no car would definitley be an issue in these senses.0 -
I think you're clutching at straws. If having a car to help with those issues is so important, it's reasonable to suggest it should have deterred you from accumulating points.0

Yep I 100% understand and fully agree with what you're saying and again, I'm not disputing I'm in the wrong in a legal sense but my habits have changed since I got 9 points and this last offence was 35 in 30 when I was going the same speed as everyone else.
...It was a stupid mistake seeing as I've been very careful and this was 1 single slip-up.
There's also no 30 limit signs on that road but I know I should have paid attention to the street lights as an indicator.
Please see below. The policeman with a radar gun was on pavement at the bend and to clarify that is 2 lanes going in the same direction.

Investigate public transport options, don't drive to court.
Too little too late. The time to change was when you hit 6.

No the time to change was after the first or if being pedantic was before any.:rotfl:0
