  • I appreciate your thoughts here.

However, I am not sure why people turn to focus on the rental agreement here, it has nothing to do with this case.

The topic was moving towards to fraud detection for the related transaction instead what I am asking help for.

As I mentioned they found my receipt based on more facts that I provided to them and they have personal information such as IKEA family number and gift card details etc I did not post it here.

I hope when people are reading stories here can keep an open mind to all possibilities, such as tenants maybe negotiated deal with landlord and the landlord could mean residential landlord or the developer in the agreement etc. I may not have provided the full picture of the case but this is limited to what personal information/life story that I want to share on the forum. This bit is really not the key element here.

I'm out - there's more holes in this story than a Swiss cheese

In summary you've had a foam mattress for 2yrs+ which only now you claim is 'faulty' & damaging your back ?

You've no real rights after this time so you're reliant on Ikeas goodwill

You said you bought the bed and you lost the reciept. You also metioned lots of other stuff that youve done including your family card and other personal details youve been asked to give.

    Hi guys,
Both me and my partner are suffering from back pain that maybe caused by IKEA MORGEDAL mattress that we purchased in June 2015.

Due to it has been a while and we have lost the receipt.

Ive contact IKEA via chat and facebook message but still finding it difficult.
They would be able to send someone to inspect the mattress only if they can find proof of purchase.

    They have asked me
    - Date of purchase -
    - Total amount spent -
    - Last 4 digits of your card -
    - Family Card number -
    - The store you visited -

    - Date of purchase - I went on a weekend in June between 11th to 21st, so 13 / 14/ 20 /21 four dates are possible
    - Total amount spent - over £450 including mattress, sofa, bedside table etc
    - Last 4 digits of your card - IVe used gift cards :(
    - Family Card number - I did swipe it but I was told it only save data for 4 months record
    - The store you visited - Lakeside

I wonder if anything I can use to help with my case?

    Thanks

You then say your landlord told you the bed is two years old. well of course, if its the bed you bought it has to be 2 years old. Why you would let a future landlord have it

We only moved in this flat since May 2017 and started to use this mattress. the mattress has been two years old as we were told by landlord. we mentioned this issue in August but now it is official.

We just hope to get a replacement if possible suits us better.

With all due respect. Ive tried to help you. There are things that need to be done if youre hoping to rely on your rights as a consumer. My advice and help will be different if you are the consumer as opposed to the landlord.

If you are not the consumer (ie the person who actually bought and paid for the goods) you have no rights for a replacement or anything from ikea, they have no contract with you. Youre contract is with the landlord who im guessing provides a mattress as part of the inventory. So, and this is where the rental agreement comes in. Your landlord has said they will provide a matress, if the matress is faulty you can demand a replacement. What they choose to do with a faiulty mattress is up to them.

If you are the consumer (same applies to the landlord if they are). You need to prove the bed is faulty. Ikea have kindly offered an independent bed person to check it out. IF they find it to be inherrent fault they can repair replace or refund, probably deducting any fair usage. (thats the 2 years not the months youve been sleeping on it).

Please dont suggest im closed minded because you cant construct your query effectively.

I cant possibly fathom how you can negotiate a deal with landlord that transferred a contract between ikea and them to ikea and you. Unless of course youve been in direct contract with ikea and theyve agreed to transfer the contractual agreements.

If the landlord has sold you the bed your contract is not with ikea. The contract is again with the landlord.

I have answered what you have asked for help for, be it you buying the goods, your landlord buying the goods and or what you should do if they did.

The key element and please be honest about this is who acutally went along to ikea and stood in front of the till handing over the gift cards?

If it wasnt you, youve got no case with ikea.

we bought the mattress and we only been living in it and using it since May. it was previously occupied by others since June 2015. we will have to sort this out ourselves.

If others 'lived in' the mattress before you, you either bought second hand or it's the landlord's mattress and not yours. In either case you do not have a purchaser's rights.(Note the various referrals to fraud and the possibility of being charged for the inspection as you have no right to it, as the mattress was not purchased new, by you)

By the way ,try sleeping on and not in the mattress, just because those before you did so.
