Problem after selling Apple Iphone on Ebay

I had a similar experience (on Amazon) and they claimed the item was not as described (very similar story in fact) then contradicted themselves on it and the list of things wrong grew. In the end I said I would take it back. Sent it back to manufacturer and they had soaked in water needless to say manufacturer returned to me unfixed. I held my ground and said I would be keeping the item as evidence, when they started threatening court action they eventually gave in.
So beware the deliberately damaged phone (which it will be if this escalates) and how EBay/PayPal deal with it!! I normally open a file in Outlook and start keeping any emails they send you need to keep on top of this.0 -

I'm sorry to rant but I've gone off ebay completely. Just about everything I buy turns out to be a lemon... I bought a cylinder head described as 'ready to fit' and 'in perfect condition'.. turns out it's not perfect to the tune of £160+vat to make it right. The seller has evaporated... wish I could get my money back because of the 'free' spiders it came with let alone a fingerprint:(

Or did they just make some idle threats about court action and then not bother? My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

Basically I held the camera hostage and they backed off.
In the end they informed me that they had decided not to take me to small claims and for me to send the item back. Since I had that in writing I said OK but I need £5.70 to send it back SD. It took ages for the money to materialise. Eventually it did with more threats of reporting it stolen if it wasn't back within 4 days etc.
The whole saga ran from start of May 2006 and the final correspondence was November 2006.

Nope. As long as the phones are not updated with the latest firmware download from Apple they work fine. I mentioned this on my listing, and I have reminded all the buyers on purchase not to download the update.
I have emailed the buyer in a business like manner saying I know what he is up too
I stated examples of his contraditictions as well. I said that I have noticed he bought another phone the day after he won my auction. I have asked him to email me pictures of this phone showing the serial no and the condition he says it arrived. I told him I want to compare it to the pictures I have of the phone. I do not really have pictures but I do have a record of the serial no. I will keep you updated on what happens. 0 -
Hi again! Since I sent my email, I have heard nothing. I just thought I put my return address on the back of the parcel. I wonder if he'll try to return the parcel anyway.0

I had an email back from the guy. He sounds like he may be backing down very slightly. He says that he will see if he can give it as a gift but is not sure as it is in a bit of a state. He is still exagerating . He says that he is still to decide what action to take but he may need to return it under paypal conditions. He did say that he purchased the first phone from America that was mentioned in my first post in September and left feedback in October, so I did apologise for that. It still doesn't explain why he was so eager to "play" with my phone last week. I am wondering if he has locked his first phone like the link refers to a few posts above and though he could get away with returning his phone to me and keeping my unlocked phone. I told him I have pictures of it though so maybe that is putting him off a bit. What do you all think?0

yup does sound like somthings amiss.if he returns it without your permission/agreement(outwith paypal requirements) i would jusy tell him he can either pay to get it returned to him arrange a courier or you will treat it as unsolicited goods0
