Just submit the POPLA appeal as a PDF under OTHER, as the NEWBIES thread post #3 says.

    :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi All,

Just wanted to share the below email with you all from POPLA.

"Thank you for submitting your parking charge Appeal to POPLA.

An Appeal has been opened with the reference 8*********.

Smart Parking have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.

    Yours sincerely

POPLA Team" :T  :T  :T :rotfl: :rotfl: :rotfl:

Would just like to thank all the guys for the help provided.

Hi Guys, Quick advice for a friend I am helping with a claim. He has a CE PCN so I advised that he copy the template from the newbies (in blue). However when you got to appeal on the website it asks are you the driver of the vehicle? Should we just hit no and carry on?
Once again thanks for all the help in my issues previously.

The reason why they have rejected the appeal is due to the ticket not having the full registration of the car.

They might struggle if they took this to court.

Many judges would regard this most minor breach of contract as trifling, and the Law does not concern itself with trifles

    https://en.wikipedia.org/wiki/De_minimis

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

Do not admit to being the driver. Always appeal as the keeper. There should be an option that he can chose.

Throughout here you are advised never to reveal who was driving!

You or your friend should start a new thread if you need more help not covered in the FAQ

Pretty sure they do not just ask that question in isolation or you can skip it. They can't insist on being told who was driving as a condition of a keeper being allowed to appeal.

If they are, send a complaint email to Steve Clark at the BPA:
