Smart Parking date on NTK

My son and his girlfriend took my (unsteady on her feet and BB holder) 90yr old mum to a retail park for a bit of shopping and a change of scenery for her. Anyway the gist of the pcn by ANPR was for an overstay by 43 mins in a 3 hour free car park.
They have a till receipt for some shopping and will be going to see the manager asap.


NTK is dated 3/11
Received 6/11
If payment isn't received within 14 days from the date of this notice.....
NTK clearly states if the parking charge notice is paid before 16/11/17 the amount of the parking charge notice will be reduced to £40
3/11 to before 16th (15th being the last day) = 13 days
Should the date have been before the 17/11/17?

You are overthinking it!
Just send the template appeal from the NEWBIES thread, using the online challenge.
You could add that an occupant of the car is a 90 year old BB holder who is legally allowed under the Equality Act 2010, the 'reasonable adjustment' of additional time to shop, and if they fail to cancel this charge they and the shop will be guilty of disability discrimination and harassment of a protected person and their carer.
Attach/upload a copy of the Blue Badge.
DO NOT say who was driving. If they don't cancel, the keeper then wins at POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There was no joy with the manager at the shop. So here's my intended appeal.

I challenge this 'PCN' as keeper of the car.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis.Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.
I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.
