Hit uninsured car
Options
My son in law rear ended a car this afternoon. We know he is at fault., that's not the question. The other driver refused to swap insrance details and wanted to go down the cash route.
Turns out the car is uninsured. Other car is taxed from Nov 1st and MOT until Feb.
What is the right thing to do now?

Advise that you will let the insurance deal........0

I'm not sure what the deal is if the insured driver is at fault. I definitely wouldn't pay cash at all. Not if they're uninsured.
The uninsured driver needs to be punished and get their licence banned. Why should they not have to fork out for insurance when everyone else does.0 -
Did the other driver admit to being uninsured or were the police/insurance company unable to locate a policy for the vehicle on their database? You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0

Thanks. Son in law hasn't been driving very long, first accident so unsure what he should do.
I've told him to not to contact other driver, but to contact his insurance company and that if other driver calls he needs to say that he requires their insurance details for the claim.
Apparently, other driver said he was insured but it was his sister's car. I said even if he had other car cover the car been driven still needs valid insurance.0 -
Son in law called 101 at my advice as other driver very quick to suggest cash deal. They told him that car was not showing on insurance database (not sure if they were supposed to tell him that)0

Since the other party is making a claim, your SIL is obliged to give him his insurance details.
The TP's insurance status is irrelevant, and he's not obliged to provide details at all.0 -
SIL did give him his insurance details. It's just that the other driver was adamant he wanted to save SIL money :-)0

It actually doesn't matter if they had insurance or not, Your sil is still at fault and his insurer will have to pay out,
That's what my insurer told me when I hit someone, The insurance status of the other driver didn't matter0
