Length of time to receive Penalty Charge Notice

I'll try to keep this brief.

I have just received a 'Bus Lane Penalty Charge Notice' from a city about 10 miles from where I live for an 'alleged contravention' (Code 34J: Being in a Bus Lane - as defined in Sec.144(5) Transport Act 2000 - as amended).

The Council say the date of detection was 2/11/2017 and the time was 10.19. They have provided photographic evidence, which is my car.

I was at home on that date and time and my husband was in bed as he had just finished his night shift and the car was sitting on the drive.

However, I don't dispute the 'offence' but it did not happen on the date and time they say. The incident actually occurred possibly 18 months ago, or longer. I have called the Council to ask for proof that this happened on the date they are saying and for better pictures, because if my husband is in the passenger seat it's the only evidence I have they have got the date wrong as he was in bed but they say they don't have any clearer photos available.

How long do Councils have to issue a notice from when the offence occurred? I am 'happy' to pay the fine but not if they are breaking the law themselves by issuing a penalty notice 'out of time'

    I recently used Google Maps Timeline to prove where I was on a specific date as it showed there is no way I could have been where they say I was at the time because i was in another country!!

    Being a newbie i'm not allowed to post links, but if you type in the UK google address with a /maps/timeline?pb it should hopefully come up for you. You can then search specific dates.

    It's amazing how much we give away to the giant tech companies!

    It could be worth having a look for the time and date in question and if it shows you were 100% not there, this may or may not help form some of your evidence (someone with a better understanding of the law may be able to clarify here....)
