Why would you surprised if I hit the two year mark? Should I not lodge my claim for unlawful deduction of wages?
I'm not saying you shouldn't lodge a claim: how could I with no knowledge of the situation?

I'm just saying that if an employer discovers that someone WITHOUT two year's service has lodged a claim with an employment tribunal for any reason, it would not surprise me if they decided to dispense with that employee's services. And before those two years are up, it's very easy to do.

And after two years, having lodged a claim, it may well be that the employer looks for reasons to dismiss you, or makes your working life so uncomfortable that you decide to leave. and it would be very easy to do this in such a way that you would have no recourse to an employment tribunal for that.

Anyway, I have a question. I have a witness statement to obtain, is there particular forms I need to use and where would I obtain them?
Who is this witness? A fellow employee, I'm guessing. sangie will know how, but will also give sound advice on advisability ...

No special form. Just typed signed and dated. The witness will have to attend the tribunal and give evidence. If it's another employee, good luck - most people get selective memory loss at the point you ask them.

It’s a fellow employee and she has already agreed and it’s in hand.
She is also willing to attend tribunal.

The organisation I work for is very large so it would be very difficult for them to do that. I know of two others that have resorted to ET claims, won, and remain there.
  • Witness Statements:

Introduce the witness - I, My Name, of Address, will say as follows:
    1. I commenced employment at Company A on DATE as a JOB TITLE. My responsibilities are X, Y and Z.
    2. On DATE I received a letter from NAME. A copy of the letter is at page X of the bundle.
    3. On or around DATE, I sent a reply by email to NAME. A copy of my email is at page Y of the bundle.

Then tell the story in chronological order, referring to the relevant documents in the bundle as you go.
