    No, that's low compared to Sassii's four figure ones!

    You will need to reach a very high bar, to convince a Judge that a Claimant has acted 'wholly unreasonably' and you will need to take a list with you to spell out blow by blow, everything about the claim and their conduct and disregard for the proper court process, if you are to get additional (punitive) costs over and above the usual £95 for loos of salary/leave and travel/parking.

    But, try!

    And take a wage slip with you on the day as some previous posters, on occasion, have been refused costs they couldn't prove.

    Any of note worth trying to include?

    Obviously them missing the deadline is one for submittting the documents is one. Harassing me for the lease copy another. Harassing me with letters etc. Can’t think of a lot more on top of that.

  • ORdinary - you cannot breach £95 for a HALF days loss of pay OR leave. THats the cap.

    How did they harass you for a copy of the lease? Youre expected to communicate with them pre court to narrow the causes of disagreement.

    They emailed me a couple of times chasing me up for it even though I told them it wasn't my responsibility. Only after a strongly worded email did they stop emailing.


    Any tips for the actual day? Do's and don'ts?

    Quick update guys


    Just received a supplemental WS from the Claimant the day BEFORE the hearing. Is that allowed so close to the hearing as I won't be able to add or submit anything else now? Does this count as a bit of an ambush?

    Anyway the updated WS mentions a date I mentioned when I provided the lease. 2 things on this,

    1. they got the date wrong (they wrote 2015 instead of 2018) and also

    2. they are saying that they could not validate the lease as I only provided a page of it (ones that were relevant to me).


    Anything I could do with that?



    Also they added in about the 'subject to any reasonable regulation' but I assume I just fight that with the DJ Skelly opinion on the case about the union jack flag? As I've already done this in the defence and skeleton argument I assume I'm covered for this?


    They've also quoted in their new WS the part of the lease about not to park or allow to park any car etc 'including any car parking spaces specifically allocated by the Management Compny to the owner or owners of any of the other apartment and save only to such extent and subject to such conditions may be permitted by law and such regulations as may be imposed by the Management Company for the good of the Estate'


    What do I need to do at this point? It seems as though they keep banging on the tune about me being in a 'covenant' or contract with the Management Company, but that doesn't mean I have a contract with them the PPC does it?


    Not sure if this is relevant but the PPC has been removed and replaced by a different company on the estate recently. Does this have bearing on anything?

    no its not allowed so you object to it to the judge and ask for it to be struck out (not allowed)
