That's not what the DPA says.
See https://www.legislation.gov.uk/ukpga/1998/29/section/13.
The DPA breach in the Op's situation does not concern any of the 'special purposes' referred to in that section.
I am aware that this section needs to be read by reference to recent case law but that's getting to be a bit too much detail for these purposes.0 -

Can't remember the exact phrase used...but essentially says its an automatic tort or something similar...
