Price error/glitch, my rights

Options
Hi, first time poster and im not sure if im posting in the right place so please go easy on me.
:j

I'm just wondering if anyone can help me out here.
If I find an online price error or glitch order an item and receive it do the company have a right to come back and receive the money of the actual price of the item.

If not, do the same rules apply if I were to bulk buy this item and possibly resell. So 5+ units.

The pricing error I'm talking about has something that is usually about £2000 for around £500 or lower.

And ofcourse this is of it all goes unnoticed by the online retailer.

Any info would be helpful

Thanks
Jamie

Assuming this is an online transaction, you are buying as a consumer, and the T&Cs say that the contract is concluded on delivery of goods ... once the goods are delivered then they are yours and the seller is not entitled* to seek further recompense for their error - they had that chance prior to accepting and fulfilling the order.

    * They can ask - you can equally say No.

If you bulk buy - what you then do is none of their business, provided that there are no terms that prevent resale.

Make sure you declare the extra income to HMRC as you will be acting as a business.

Bear in mind that any commentary in this thread is merely opinion and is not in any way legal advice. If you happen to use the opinion and we happen to be wrong, it's your problem not ours. :)

Is this in theory or has it actually happened?
  • You'd be wise to consider a few possible consequences as well:

    - If you buy all of the units at once/in bulk then you may flag up as an unusually large order and help them cotton on to the pricing mistake BEFORE dispatch = order cancelled

    - Due to the high value of the items and the fact that you KNOW a pricing error exists, you could potentially face accusations of defrauding the company. They may report you to the police. Whether this would be a genuine complaint or not is debateable (I cannot confidently comment either way), but its still a lot of extra potential hassle.

    - If you are making this purchase as a business (which can be argued) then you have no consumer rights, and so they may have more scope to pursue you for the balance owed if they have been delivered to you. You'd probably need to employ a lawyer in such circumstances.

Once you know it's a mistake then it is no longer a valid transaction and as already pointed out could very well lead to a criminal investigation.
  • yeah this is what i was worried about and is why i posted here. i didn't really want to be bulk ordering with the possibility of defrauding the company.

I have ordered one of the items for personal use knowing its a pricing mistake, also knowing that they can cancel my order at any time. thought id risk it after seeing most sources online saying that if a company prices an item wrong its their issue and they have the right to refuse selling it to you at this price. (im also paying something for the product around £500 instead of just ordering it for £0)

currently the error has been fixed so just going to wait and see about my one unit now.

Thanks again for your input guys
