What am I entitled to?

Hi
We brought 8 bottles of moisturiser on Pre order duty free at a big saving. We got the items delivered on the plane but stupidly forgot to pick them up when leaving, we quickly realised so called the lost and found number for Thomas cook at Manchester Airport (a 3rd party from TC). A few hours later we got a call to say the items have been found. When we called back the next day the items had disappeared. They offered to replace the items or give a refund. Due to the saving we wanted the items replaced and was told that would be fine. However today we’ve been told they can’t get the items because they are not passengers and are only willing to refund what we paid plus £10 extra. Can they do this? Or are the legally obliged to replace the items? If we take the money and buy the items elsewhere we will only get half the amount. This seems unfair as they were in custody of our items & admit they have got lost in their care.

I would think that you would be entitled to be put back to the position you were in to start with so a refund would do that .
You started the whole problem by forgetting to pick the goods up.make the most of it, we are only here for the weekend.

OK, the answer is you have received a full refund plus £10. That is £10 more than they needed to give you, so that is the best you are going to get.0 -

They shouldn't have ended up in their "care" in the first place!!
That's the whole rub.
You are entitled to your items back or, if the items cannot be located, a full refund.
The £10 on top is a nice little gesture considering their fault only stems from something which was your fault.
IF ANYTHING, they should charge YOU for looking after the items in much the same manner that the police charge you fees if your vehicle is stolen + recovered by them. Not 100% the same thing like, but similar.0 -
