Cash purchase / stubborn estate agent?

Hello, i am hoping for a little advice. We are able to purchase our dream familly home and have all the funds available. It is our intention to seal a deal on a property sharpish and with little hassle.

We found a property that is essentially over priced but, in our eyes it's worth it. The house was up at £465k and we offered £450k, the owner straight rejected it, we increased to £460k and she has accepted that but has also counter offered if we pay the £465k she will leave sheds/light fittings / curtain poles / lawn mowers / green house / some shelves etc. Basically she is saying if we pay £460k we will walk in to an almost naked shell.

I'd like to express again the house is on the over priced side and it's asking price is primarily based on the nice finishings. There isn't another house on the road or very local area that touches 300k.

Also, the estate agent is not giving us anything, we went for a second viewing today, we met the owner who had paperwork prepared for us *her counter offer and inventory*, turns out she emailed that to the agent a week ago and it was never passed on to us. At 12pm today we rang to accept this inflated over priced counter offer of asking price + aswell as agreeing to buy 19years hight rate FIT contract *solar panels* at 10k. So that's £475k we want to offer, but the agent won't return our call, I've purposely left it this afternoon.

The vendor reckons she has 2 asking price offers on the table, both are attached to chains and need mortgages. We feel we should be in the driving seat to be honest.

    So this house is only worth 300k and you are paying extra for the nice furnishings? Why don't you buy one of the £300k houses without the nice furnishings and furnish it to your taste instead?

    It may be your intention to " to seal a deal on a property sharpish and with little hassle." but that is only possible if the seller has the same intention!

    It appears there is ongoing negotiation. Until you and the seller agree a price, and what it includes, nothing is certain.

    You may believe it is 'over-priced'. That is your opinion. However

    * in that case, why pay so much? If you are willing to pay that much, it must be worth it to you.

    * the seller may disagree and believe it is a fair price, or even think they might get more

    Either way, you must simply either make a deal or walk away.

    You say the EA "is not giving us anything" and "the agent won't return our call". That may be because the seller has not instructed the agent what to do. The agent does not work for you - he works for the seller.
    We feel we should be in the driving seat to be honest.

    Sorry - but you aren't! You cannot force the seller to sell (whatever the price), nor force the EA to do/say anything the seller does not want him to do/say.

    The sooner you change your attitude, the sooner your blood pressure will drop back to normal.

    All you can do is confirm your offer in writing, and wait.

    Vendor is being greedy.

    Explain that your £460k offer included all fixtures and fittings and the transfer of the FIT contract.

    She might not accept the offer but it is ridiculous to say it is accepted and then add on another £15k of stuff which would be inclusive under normal circumstances (forgetting lawnmowers and tat).

    Personally, I'd let my offer stand on the basis of all F&F included. If accepted, I'd incur minimal legal expenses until the F&F list was provided, indicating the said items were included in the sale.

    If the offer were to be rejected, I wouldn't lose too much sleep over it. They sound like they'd cause you a lot of stress during the conveyancing process.

  • Thanks all, the house was purchased by the vendor in 2007 and underwent a big refurb. In 2013 it was marketed, in 2014 it was marketed with another agent, again in 2016 it was marketed with a 3rd agent and now in 2017 it is marketed with its 4th high street agent. I rang the previous agent to see if he'd be kind enough to tell me anything. He said they never had any offers placed on the property. I'm going to see if I can ring the 2013/14 agents to see if they know anything.

    It's not that I think I should be in the driving seat in that arsey kind of respect but. I've offered this lady the full whack and it's becoming difficult at this early stage. From research I've done, the house isn't selling. And I'm starting to think the vendor might be the issue, even though I find myself blaming the agent...

    So what would she do if you didn't buy the PV FITs for £10k? Would she remove the panels and take them with her? She won't be able to transfer the higher FITs rate, only start a new installation at the current rate - they really aren't worth much to her.
  • Erm, the house is over priced - but you've offered the asking price, and so have 2 other people. Am I missing something?

    You are probably coming across as too keen and vendor basically playing you with all these 'extras'.

  • I did some research and am lead to believe the FIT rate can be leased, or sold on, in effect if I was to reject the FIT she could sell it to a 3rd party, as it is a much more attractive investment than say, a cash ISA. I am happy to buy the FIT anyway, for this reason. It has 19 years on it. If my information is incorrect, and she would have to remove the panels then, let me know with some concrete info because that is a serious bargaining tool on my part.
