I have to disagree that the car being on finance is irrelevant. I had a problem with a faulty gearbox on a car on finance and was advised to push for repair from the finance company. They arranged for the car to be repaired and I carried on until the term was finished (this was 10 years ago, and had the assistance of a solicitor that worked at workplace)
A HP car is owned by the finance company, so it may be worth a go and even speaking with the Financial Ombudsman Service.
No one on this forum can specifically say if the problem was there or not when the car was purchased. If fuel has been slowly leaking through the injectors over a period of time to cause the engine to fail then there may be some merit to say the fault was there previously.
Yes this is going to be a real uphill battle, and you may need to get independent reports and inspections, but I wouldn’t say this is as cut and dry as say a water pump failure.
One thing to be aware is any assistance may be offered based on a deduction for wear and tear and betterment.
In 3 years of owning my 530 (luckily all under warranty), I had 3 HPFP’s, 2 sets of injectors, 2 sets of plugs, 1 set of coils (plus a number of individual ones) multiple sensors replaced. I was glad to give it back to the finance company at the end of the term. Problems with these N53 engines are just too frequent.0 -

The lesson here is if one buys a BMW with full service history it's easy to extend the warranty (which now includes wear and tear) up to 100K miles.
Secondly one needs to check on BMW forums and/or with a BMW dealership for any faults which appear, as they may well be know issues.
Loads of folks have had even old wheels replaced for example, never mind injectors.
