    Tuna , in my extra, they are on the end of a row. in my superstore, they are in normal aisle and on end of the row but still sel says 3.50

    I'm not sure why the sunflower ones are reduced in some stores but the brine in others? I think hukd reported the brine ones x

    In my extra, they had them in spring water or sunflower oil. In the superstore they had those two plus the ones in brine as well.

  • Good afternoon all! I will have to investigate Tesco for tuna on Monday I think, I doubt I'll get to one before then. I'll accept the fact they might all be gone! Although to be honest we have so many tuna fillers that it might not be a bad thing. I also haven't bought any Magnums yet :-/. Our freezer is full to the brim.

    It's so cold today! I popped out for a run at 8am and there was a frost. I'm off down the road to a board games night tonight, I love a good board game so I'm looking forward to it :-D.

    Regarding the report of the cashier who tried to ban someone after buying £10 three times, I now note the terms and conditions "13. There is no limit on the number of Swipe and Win entries per customer...."

    Report them to the Competition and Markets Authority and claim that the trader is imposing an undisclosed hidden term, that runs contrary to a term in the written terms and conditions, contrary to the requirement of good faith, that indicates an instance of how the terms and conditions are being operated in practice (with the undisclosed term added into them by the cashier's action) that therefore is an unenforceable unfair term under the Consumer Rights Act 2015. There is, you'd claim, a conflict (and not just a conflict but an outright contradiction) between terms (term 13 and the term contained in the unannounced unwritten terms) and therefore unclear and not plain and intelligible which term applies - if it is the unwritten term, with the cashier's action purported to overrule term 13, the appearance of term 13 when it does not apply is therefore misleading and as a result unfair. As we are entitled to rely on the least favourable meaning for consumers presumably, you may argue, this is the case? As for trying to enforce a ban on you, you would perhaps say breach of contract arising through previous course of dealings (after all, you'd bought three times) in which Term 13 was incorporated and then of course the rule of most favourable meaning applies instead and Term 13 now applies.

    As if. I don't know whether the above arguments would get past, but at least good to know the perspective I come from. Traders are also entitled to refuse to serve people when they do so for reasons that are not unlawful discrimination.

    Sometimes, some cashiers just don't like people like us that use terms and conditions to try to get the most legitimately out of any company and save ourselves money. The problem is that, if we do so too much, the trader can simply change the written terms to reflect next time and close the loophole that there was none (we were just using the terms the way they were and it is impossible to abuse terms by following them in my view - we are doing exactly what the terms allow us to do) - they can simply change the terms next time the promotion runs (I mean by amending the wording on their website or in their leaflets etc.) or withdraw the promotion and not operate it again. The end result is therefore not of our benefit if too many people use the terms in a way a trader doesn't want or start trying to challenge them. Traders set the terms - my view is it's then their fault if they don't like the way we use them but then they can just withdraw the promotion and it's lost from us. Unfortunately too, for us, it can backfire, if we don't follow the terms and are then 'caught out' by not having complied with them - so the other side is we certainly do have to read them in advance and ensure that we are following them so as to qualify for the promotions. We are not being caught out if the fault is ourselves for not reading and following them, even though we might feel that way.

    My view to people not liking me or not liking the way I use terms and conditions is tough - I'm not here to be liked but here to follow your terms for what you promise. Even if your machine then gives me the minimum that it has to and I dislike you for it:mad::(:rotfl::(.

    My store is an 'Extra' and had all 3 varieties in stock but the sunflower & spring water both scanned at £3.50 - only the brine scanned at £1
