For service, it is merely a rebuttable presumption that service is 2 days after it is put into the normal postal system (if sent first class)
If they didnt send first class, there is no presumption of delivery at all, I dont believe
If they dont have proof of posting into the RM system, they dont even have that presumption, as they cannot show when it entered the normal postal system
POPLA believe the PPC if they say they submitted it. but that isnt what is required - POFA requires that it is RECEIVED. A WS stating no NtK was ever received, if the witness is credible, IS EVIDENCE that it was not received.0 -
Right, received an LBCCC. The thread I read in the sticky seems to be really outdated. Whats the best plan in regards to fighting this? And any guidance on filling out the forms they send with the LBCCC?0

Aside from complaing on facebook, what do I do now regarding this? Can the above link or rather the court document be used against them?0 -
My specific questions are:
In the Reply Form sent to me via parkingeye, it asks if I wish to send documents. Is this documents that will be used in court? Or do I wait for court summons and then submit them? Because there are a number of things I wish to submit to them, but wanted to know if there's any point doing it now.
Secondly, there's a financial statement form included with the reply form. Do I have to fill this out? I don't really want to give parking eye any details like that. Plus its not really relevant.0 -
