Barclaycard online 2003

Hi folks!
I'm hoping that somebody can help by confirming that Barclaycard online applications from 2003 would have had the pre-ticked box for accepting PPI?

I made a joint PPI/ Plevin complaint and whilst Plevin has been upheld and they have sent a cheque for that, they deny that I was mis-sold PPI.

I claimed there was a strong implication that taking out PPI would improve the prospect of being accepted. I also stated that I was entitled to 6 months full salary so an insurance policy was not needed.

Their response is that as I applied online there was no advice given and I made my own decision. I'm sure that the box was pre-ticked so that to me is an implication that you should take out the insurance. They also say that although my sick pay entitled me to 6 months salary the policy entitled me to 12 months cover so I would have been able to benefit from the policy if I needed to.

Also, surely it has to be the case that if Plevin is upheld the policy must have been mis-sold as it has been unfairly administered? Feels like an admission of guilt to me.

I'm certain that the box was pre-ticked but this was back in 2003 so am not totally sure.

Please help!

    If the Bank's investigation of your complaint has not shown that there was a pre-populated box for PPI on your particular application there is little you can do. Did you actually state that the box was pre-ticked as part of your complaint? If so, the Bank should have addressed this as part of your rejection.

    There is no point complaining there was a pre-ticked application unless you are certain. You could, however, ask the Ombudsman to check if the box was pre-ticked if you doubt the Bank.

    In what way was it strongly implied?

    Plevin is not about misselling in general, it relates to a lack of transparency on one particular point.
  • I'm NOT 100% certain, no - this is back in 2003. I think I remember it being pre-ticked and I'm pretty sure I had a dilemma then as to whether or not un-ticking it would cause my application to be declined.

    So yes, that being the case there was a strong implication in my mind that I should take PPI (if I am recalling correctly).

    That's not good enough I'm afraid. It either was or it wasn't. You cannot accuse them of wrong-doing simply because you think it might have been the case.

    As I said, have you already made this allegation or is this something that has since occurred to you only after the complaint was rejected?
  • I haven't made this allegation because I cannot be 100% certain, being so long ago, hence my question to the board being a request to ask if anyone knows that this box would have been pre-ticked.

    Not a trick question, just asking a forum full of people in a similar position whether they can recall the online application at that time.

    Such information is known only to your Bank (and the Ombudsman if they check). Certainly the practise was discontinued across all Banks by 2006.

    The problem is that it wasn't uniform across all applications, nor across all lenders.

    Basically, you only thought of this after being rejected? It's a little late now I'm afraid.

    The Bank will have certainly checked this as part of their investigation of any internet sale , but won't have referenced it because you didn't.

    If you refer your complaint to the Ombudsman, you could mention in passing that you "think" there may have been a pre-populated box so that you get final closure.
