Pension splitting on divorce

Advice please for my brother. He has a small deferred pension form the forces due when he is 65. After he left the forces he met and married someone who had children from her 1st marriage. This marriage has now broken down. They are trying to sort out the house but she is now trying to claim a share of his future forces pension. They had no children together and both worked throughout the marriage. As I understand it this is not a maintenance situation, he did not adopt her children. Also as the pension was built up before the marriage, she should have no claim. Although he brought more equity into the marriage, he is quite prepared to split the house equity equally but she is trying to claim more to offset a future claim on his pension. My brother was trying to be amicable and avoid solicitors but not sure if he can. Can anyone help?

    Your brother seriously needs to visit a solicitors....these situations are very complex and he could end up seriously out of pocket...
    This site is a good starting point - not recommending the solicitor (or not recommending him IYSWIM !) but the site explains the process and the reasons quite well...especially the section especially for men and divorce.

    I am not an expert, but having been involved on the wings with Mr P finalising his divorce, the process does not work the way you would expect it to at all.

    He needs to speak to a solicitor...pension splitting & divorces are a potential minefield.

    IMHO i would say she's pushing her luck, and don't forget if she has a pension, he's entitled to do the same.....
