Rights to a replacement

The retailer is only interested in your consumer rights, they can fulfil your rights to you by giving you a refund. No if's, buts or maybes.
By going to the retailer you are listening to Which, which is technically correct but not in the sense you are hoping for.
The only way you have any hope of repair or replacement is with the manufacture, they don't care about your consumer rights but will if they can honour the warranty.
You need to first understand the difference between your statutory rights and a warranty, they are not the same. Going to the retailer is all very well, but it's not always the best or easiest way.0 -
They have not misled you, they are saying that if you want a repair, which they don't have to offer, then you can always use the manufacturer's warranty, your choice. Yes you can choose a remedy but you cannot insist on one and certainly can't do so if they don't have any stock.LookingForHelp4Me wrote: »They have misled me - that are saying to go to the manufacturer for a repair.
From Which: "Your rights under the Consumer Rights Act are against the retailer – the company that sold you the product – not the manufacturer, so you must take any claim to the retailer. "
Also consumer rights gives the choice to the consumer not the retailer. My choice is for a replacement.0 -
Yes, I am asking here because it was not clear to me. The consumer rights suggested to me that I could request a replacement and I wanted to check this. Also the rights relate to the contract with the retailer, especially in the early days after purchase.powerful_Rogue wrote: »I hope you're asking here first and haven't gone off demanding and spouting about your incorrect rights first.
From what you have posted, the company is complying with the Consumer Rights Act. This has been explained in the many posts above.
Your options are to accept a refund, or send the item to the manufacturer for a repair.0 -
You’re just picking and choosing bits of the regulation wording to suit you.
You can choose a remedy BUT the retailer can decline if disproportionately costly, which they are doing.
They’ve offered all they have to, now you have to decide if you want the manufacturer to repair, or if you want a refund.0 -
Of course you can request a replacement. But they can offer you any of the 3 options described-which they have.No free lunch, and no free laptop

Most people who post on here would rather have a refund rather than a repair, here is a person offered their money back and does not want it,you could not make it up.0
