Speeding Fine

I have had a search on here but cannot find anything that fits my scenario.

Back at the beginning of October I hired a car from an independent car hire company. There was myself and another driver driving the hire vehicle whilst we had it. I was passenger at the time when the driver suspected he got caught speeding by a camera van, went from 60-30 zone and the van was hiding behind bushes (not condoning speeding but it was just one of those slip-ups).

It's been 2 weeks since I returned the vehicle and I have noticed yesterday a £45 transaction been taken out by the hire company. I phoned them and they have explained that this is their "admin" fee for giving driver details and returning a Notice of Intended prosecution.
When I asked who's details they gave, they said that they have given my details, which is not correct. They did not contact me to discuss who was driving before returning this form, so they have messed up.

Is it possible to still change the driver details once the speeding ticket comes through in my name? I'm assuming there will be photographic evidence that shows that I was in the passenger seat.
Second question, considering the hire company have charged this £45 fee to fill out the details, but have done them incorrectly, would I be within my rights to request a full/partial refund of this fee?

I would appreciate any help, all this is new to me, never got a fine etc or anything before so it's all quite unnerving !

    I think so but unsure - we only advise on parking issues.

    Their extortionate admin fee will have been in your agreement, and they will have sent the hirers details to the police, what else can they do?

    You will get a NIP from the police and will then have the opportunity to name the driver.

    I was under the impression that the NIP would go to the hire company and they would name the driver?
    Yes the fee was mentioned and I don't have a problem with it but if they've named the wrong driver without asking then the so called "admin" has been carried out incorrectly hence why I'd question if a refund is owed

    That makes sense, thank you. as I say never been involved in anything like this before so got a bit worried and confused how it all works. Thanks for your help.

    As above, the hire company will have named the person that hired the car, as they cannot possibly know who was driving, even if you had added a second driver to the insurance hire.

    You will get a NIP in your own name asking you to name the driver, which you will need to complete and return, then if you name someone else as driver then they will in turn get their own NIP- and so forth.
