Parking ticket for entering one vehicle reg letter wrong

I have received a parking ticket from smart parking ltd and although I payed the ticket, I got one letter wrong in my vehicle reg. So I appealed my parking charge and as I work away when I came back home a month later I had received letters from smart parking saying although we know you payed it still breaks our terms and conditions and my popla code had expired and I also got letters from debt collection guys saying I need to pay 170 now, and if I don't they will advise smart parking to take me to court. I just can't get my head round the fact smart parking knew I payed for the parking but did a mistake and they have still given me a parking charge

If Smart were to take you to court I venture they would be unsuccessful. They have lost nothing and appear to be trying to penalise you for an unimportant breach of contract due to a very minor human error of the type we are all prone to. It is also imo a waste of court time and should be discouraged by judges who can impose unreasonable behaviour costs, (CPR27.14(2)(g), on such claims.
It also may be an unreasonable term in a consumer contract, de minimus, and a breach of your privacy contrary, to the Data Protection Act. If they were to take you to court and lose, they could very easily end up paying you money. You never know how far you can go until you go too far.0 -

Yes, but surely you DIDN'T say 'I paid' in your appeal, telling them who was driving?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
