Good evening ,
After months of threatening letters from DRP which as per the video in the newbies section became paper aeroplanes , things are getting a bit more exciting and I got one from Gladstones solicitors today .
Looking at other threads here , the fact that their name is associated with the "fine" while still prompting me to pay drp means that this is just another collection/extortion attempt , this one with a little bit more gravitas .
This parking offence is supposed to have taking place in a shopping centre in Glasgow which I have never visited in my life but after reading up on smart parking ltd I decided not to waste time on the scam .
I suspect things will now escalate to a letter before claim sooner rather later .
The Newbies thread briefly talks about Scotland so my question is about the post#2 about court claims , is that the same procedure in Scotland ? If not what can I do to meet this head on .

Wonder if there is a chance of a DPA claim against Smart in Scotland?
Why not ask the DVLA who asked for your details and then compare them with where the car was on the day. Are you based in Scotland as well as the event taking place in Scotland?
If so the advice is never, ever, ever reveal who the Driver is. In Scotland POFA does not apply and the PPC can only pursue the Driver, they cannot pursue the Keeper.
And technically, if the event occurred in Scotland, so should the "relevant tribunal" be in Scotland - for the purpose of Civil and Criminal Law, E&W and Scotland are two separate, and very different, countries. This is the case even in the PPC and the Driver are both based in England.
An English court/judge cannot be expected to know what the law in Scotland is, and vice-versa. And as Parking law is entirely different in Scotland (Clamping has been illegal for years as a form of Theft) a Scottish case should NEVER be brought to an English County Court.0 -
I can't see it , the shopping centre is a good 2 hours away from where I live , I would have noticed the vehicle disappearing . It is a works van which is why I thought it must be bogus and a scam .0

I assume it wouldn't be beyond them to get the plates wrong ? That or a driving ghost !!
I saw an ANPR pic the other day where the glare from the sun had blinded the camera to part of the reg plate but the PPC made a 'best guess' as to the number and issued a PCN to an RK who, at the time, was 350 miles away from where the incident occurred.
