At fault accident in hire car arranged by insurance co

Hi

I'm looking for some assistance with an accident my husband had.

His car was being repaired after another driver drove into the back of him. His car insurance co arranged a hire car for him while his car was being repaired.

Hubby then had a slight 'kiss' with another car in a car park. Minor damage just scratches but he was at fault.

When he looked at his rental agreement there is no mention of 3rd party cover. Admiral and Enterprise now both seem to want to pass the buck on who should cover the third party damage. Enterprise wants a copy of my husbands car insurance policy documents - I assume to check if that covers him 3rd party for driving other cars... but the contract for the hire and payment for the hire car is between Enterprise and Admiral. Why should my husbands car insurance policy be used?

Yes he is at fault but the contract between Admiral and Enterprise should included a clause for third party damage?

    Typically when providing a hire vehicle following an accident, your insurance is temporarily 'transferred' to the hire vehicle (assuming the hire car was arranged through Admiral) and therefore they should be being more helpful with this.

    My policy document with Admiral specified it is for vehicle with REG XYZ and
    or any private vehicle loaned to the Policyholder by an Admiral approved repairer under the Making a Claim page of their policy
    and that section in my documents is:
    Courtesy cars provided by our Approved Repairers will be covered under your insurance policy on the same terms and conditions
    as your car (Comprehensive cover only)

    I was previously with Bell (a trading name of Admiral) and my insurance policy applied to the hire car provided by Enterprise following an accident so assuming you had fully comprehensive cover and Admiral arranged the hire car, then I would refer them to this section in your T&Cs (just double check it is in your policy documents)

    If they didn't arrange the hire car then your Admiral policy actively excludes DOC (drive other car) cover for hire vehicles:
    You will be covered for everything listed in clause 1a when you are driving any other car as
    long as:

    the other car is not a hire or rental car, is not owned by you or your partner nor obtained
    by you or your partner under a hire purchase or lease agreement

    in which case you'll be at the mercy of Enterprise and their cover and extortionate excesses and fees etc.

    Is enterprise dealing with your claim or did they just deliver the car to you from one of their branches?

    Are you claiming through admirals claims management company Auxillis? When i made my claim there was little sticker inside car showing who to call should i have accident.

    Imo if you have made a claim on your policy and it is being repaired under your policy, admiral will provide cover as they sould have instructed enterprise to deliver vehicle and transfered cover as per policy docs.

    If however you were passed to auxillis who instructed enterprise to deliver car them it will be them.
