Un-returned Deposit

Hi.

Need some advice or where we stand.

Summary:
Order aluminium sliding doors
Paid deposit.
Company went into administration
Bosses of old company started new company and promised to honour our contract.
Told after long delays that they were struggling to provide doors due to problems with glass manufacture etc.
Offered a refund.
We accepted.
Still no refund to date.
Made claim claim. Classified as unserved as there was no-one at the premises.
Re-serve notice period expired due to mis-communitcation from MCOL
New company applied to be stricken off. We have lodged an objection.
Company directors have resigned. Company still active on companies house.
Unusure as to whether spending another 150 quid to make another claim and whether we have any rights to so.

    How much was the deposit, and how and when did you pay it?

    Pursuing the company sounds like a no go. You'll be one of many creditors and unless you are willing to pay the deposit for liquidators to get involved the company will likely just be struck off for not filing annual returns eta

    If you paid by credit card you may have options. If not time to move on
  • Do you know what has happened with the old company's assets?

    If the directors have moved assets out of the old company into a new company without paying creditors, they will find themselves to be personally liable and may be pursued.
