Hi There,
I recently got an alert in my email telling me I have a CCJ. I am not a UK citizen, left UK 6-7 years ago and I realize that I can apply to mark it set-aside(I'd like to do that because in case I want to move to UK at later stage it will help). I don't live at my previous address nor I was aware of this court date/judgement!
Now, I don't know what evidence I attach with my application? My utility bills? Also, what do I mention in the application?(Don't know the legal words)
Please help

Please do not acknowledge it in any way yet eg. Responding to email, calling any numbers provided, etc.
Please wait - somone far more knowledgeable than me will be along soon to give full details of what you should do - but mean time, it will likely either be a scam, or a "phishing attempt". even if it is real, you need to approach it carefully with regards to statue barred etc.
Hopefully you'll have a reply from one of the geniuses here soonPeter
Debt free - finally finished paying off £20k + Interest.0 -
There's some info here
https://www.nationaldebtline.org/EW/factsheets/Pages/howtosetasideacountycourtjudgment/settingasideaccj.aspx
Don't include any evidence at this stage - just an outline of your defence will do so the court can see that you have a reasonable prospect of success when it comes to a hearing.0 -

To add to fatbellys post about how to deal with a CCJ, I'll say this.
While there are sometimes scams that involve making you think you have a CCJ, there's a simple way to check.
https://www.trustonline.org.uk/
You can find any CCJs that may have been awarded against you here.
If it appears, it'll be legitimate and thus, need dealing with accordingly.

I would take a closer look at the email before doing anything else. Open up the full email header and look for evidence that its come from the UK. Has it come from a UK domain? Is the reply address the same as the senders address? etc.
Is it logical that the UK legal system would have your email address?

Who was the email from. It's highly unlikely the courts would notify you by email, though a DMC who requested the CCJ could.
Whilst you are not in the UK, remember that CCJ can be served to last known address, so did you tell creditors you were moving abroad?
You can check what CCJ you have, as had been said and it will say who applied for it but not what the debt was for.0 -
Something of this nature would not come via email, chances are it may be from the debt collector/creditor who has obtained the CCJ, but it wont be from the courts
Dont be offering anyone anything just yet, check trustonline to see if a CCJ has been registered at your last known address, then take it from there.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Yes I did check trustonline and do have a case against me. The email was from credit monitoring agency's alert so its legit. Just want to know how to deal with it0

Well credit monitoring agency just simply offer a paid service to monitor the CRA.
So have you found out which company requested the CCJ.
In considering set aside, you need to consider the reason why it should, the cost vs the debt and when you are likely to come back into UK, and the fact that if granted it does not distinguish the debt that would still need paying.0 -
Hi addictive_mate
Do you know what the debt is actually for? Nic_c makes a good point, a successful set aside will not mean you no longer have to pay the debt. It means the court action can begin again. If you have no grounds to dispute that you owe the debt a new CCJ can be made.
The only advantage of this is if you can pay the debt in full within 1 month of it being made, then the CCJ will not be recorded on your credit file. However the court may not even agree to the set aside if you don't have grounds to dispute it and the claimant followed the correct procedure in obtaining the CCJ.
I'd suggest you seek specialist advice from one of the free debt advice agencies on this. You can use their webchat service if that is easier for you from abroad. Good luck with it all.
