  • Great news, CEL discontinued a load of other claims just before Christmas as well. And well done for taking advantage of what the forum has to offer without needing too much hand holding!


    You could, if you have not already lost the will to live, now write in and ask for a costs order, and ask for this to be dealt with on paper rather than at a hearing. Peperlini's thread contains a precedent letter, a Skeleton with all the legal arguments, a schedule of costs, and an offer letter to CEL. You could use these and adapt them. Personally I think it's worth a try, you have nothing to lose. You will have to adapt the Skeleton to your own circumstances (eg you may not have sent a Pt 18 request, you may or may not have sent letters asking for more info, and it might not be just the old PD that applies to you but also the new Protocol for Debt Claims, if your claim was issued post-1 October - parts of the old PD continue to apply (the sanctions for non-compliance in paras 13 onwards) but the pre-action obligations are more prescribed in the Protocol). If you want any help, have a go and post a draft on here.
