Parking charge notice on a free car park!

Hi everyone,

I’ve read the newbies forum but feel like my situation is a bit confusing.
My local train station, Sandwell and Dudley, is free to park for up to 7 days as long as you have a valid train ticket. The driver parked on the car park, admittedly on a grass verge, as has been done many a time and after being in the car park for 5 hours, the driver came back to a yellow windscreen notice. The same kind that many have mentioned on here for My Parking Charge. The driver waited to see if a letter was delivered which came on Saturday morning. It is a parking charge notice, not a penalty notice.

Completely confused about what to do! Any advice would be helpful!!!

    bylaws apply on train station car parks, yet they like to pretend they can issue PARKING charge notices

    they certainly CANNOT enforce PENALTY charge notices

    they dont like clarity , so they like to bamboozle people who dont know any better

    which PPC issue the pcn ?

    ok , whoever it is addressed to , appeal as KEEPER within 21 days and use the black text template from the NEWBIES sticky thread

    this will be refused and they will say the charge is valid

    ignore after that

    after 6 months the TOC cannot enforce any penalty charge in the MAGISTRATES COURT (because bylaws apply and POFA2012 does not apply)

    VCS have 6 years to try a court case

    come back if you get an LBC or an MCOL , for further advise

    Sorry to appear pedantic, but wasn't it the keeper waited to see if a letter was delivered which came on Saturday morning?

    It really is important to keep the idea in your head that the keeper and the driver are two different people.

    The PPCs trawl forums waiting for people to trip themselves up.

    Just noticed regarding dates. The contravention date was 18/10/17 and the NtK was received 28/10/17
    The understanding on my part was that these companies could not access data from the DVLA until after 28 days after the contravention?

    Not in the case of these ‘MyParkingCharge’ warning notices. Seems that the DVLA have swallowed the VCS (and sister company Excel) line as they say this is not a windscreen charge per se, so when attaching that Notice to the windscreen they will have taken photos of the vehicle and are now treating this like an ANPR camera capture, and a NtK appears within 14 days.

    It stinks, but it just shows how devious and manipulative these outfits are in flaunting/bending the rules and the DVLA seem utterly powerless in holding them back and protecting the public. There again, the PPC network pay the DVLA £15,000,000 (£15 million) per annum, so it would take a very brave DVLA boy or girl to say ‘No’ to them!
