Blue badge Euro parking fine

Hi, I’ve a question regarding my parking fine that I received at Govan Cross shopping car park. Euro car parks is the company that issued me the ticket.
As a blue badge holder I had parked in the disabled bay as I have had a stroke. I genuinely didn’t notice the that I had to pay. I must have not noticed the car parking machine.
I had left my car for about 5 hours parked in the disabled bay. When I came back I didn’t have a ticket or any indication that I was going to be penalised. No other car in the disabled bays had a ticket to say I’m here till or a fine.
The ticket had arrived about a week later saying if you can pay it just now it will only cost you £40. They had 2 photos, one arriving and one leaving which were timed.
I had appealed. I’m just reading the forum and I have realised that after my appeal was refused I had put in it the letter “I parked...”
The forum repeatedly says to not tell them who was driving, which I have.
The disabled badge was on show which I presumed was needed to enable use of the disabled bays. So, does this mean that Euro Car parks can come after me as I’m the driver..? Am I as well stumping up the cash and just learning from it..?
I would appreciate any help from the people on the site.

    That's just their lazy way of pretending to manage a car park, use anpr to check time in and time out then issue a charge for those that don't pay up or go over their time.

    They don't care a jot about the disabled bays which can only be monitored by a foot patrol!

    Very few private car parks that charge make concessions for the disabled, however obviously the signage was non compliant if you never saw it

    no point contacting the debt collectors or the parking company

    IGNORE is the best option, APART FROM COMPLAINING TO THE LANDOWNER that the EA2010 applies and they must comply , it is not "their choice at all" but they can make charges if they wish , so if the driver displayed and failed to pay the charges then the driver was at fault

    if you get a letter from the sheriffs office, only then should you deal with it
    this time period for a court claim expires after 5 years have elapsed

    advice for SCOTLAND is contained in the NEWBIES FAQ sticky thread

    there is no POFA2012 in scotland, so a keeper is not liable, hence why you AS KEEPER should not contact them and not reveal who was driving

    maybe near the end of this year when the new PARKING BILL becomes law, the advice "may" change

    Hi all, I'm in a similar situation as the original post and I'm considering a few different strategies. I'd appreciate anyone's advice based on their experience?
    • Just ignore all letters [STRIKE]- bit nervous about this and want to be proactive so would rather not go down this route, but will do if people think this is the best option. [/STRIKE]
    • [STRIKE]Reply to Euro Car Parks and tell them that no ticket was bought as their signage is not clear enough for disabled drivers (i.e. signs cannot be read from inside a car), however I would be willing to pay the £4.50. If they want to make a civil claim then they will need to provide evidence of who was driving. Any further attempts to extort more than the £4.50 will cause great stress and alarm to the disabled person and will be met by a counter claim for at least £500 under the Equalities Act. This is my preferred option at the moment. [/STRIKE]
    • Complain to the land owner - [STRIKE]however I believe concessions for the disabled are decided by the land owner so can't see this succeeding.[/STRIKE]

    This is not a similar situation and your hijack has only got you advice that is useless to you because it applies to the wrong country..!

    You now need to get yourself into the Newbies Sticky to see the proper, current advice for England and Wales. Then start your own thread if you need any further clarification. Which is no more than you clearly agreed to do as part of your signup.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
