Gladstone lose on behalf of District Enforcement "chancers"

Gladstone lose on behalf of District Enforcement "chancers"

http://parking-prankster.blogspot.co.uk/2017/10/gladstone-lose-on-behalf-of-district.html

The hearing was the usual Gladstone shambles. The defendants sent a representative from their company. Gladstones sent Miss Jackson. In court, she admitted that they could not find a current contract and so just bunged in an old one. She also tried to argue that an aerial photograph from above, was a site plan, even though it didn’t actually show the place where they were claiming the vehicle was parked and the building in the background was so obviously different. This just had the effect of making her look incompetent.

But the title of this blog is inaccurate. Gladstones don't lose, it's their clients who are out of pocket.

Gladstones will have charged fees for issuing the claim, compiling the WS, and will take a cut from the advocate fee. They retain all of those fees whether the case is won or lost, and on the other side of the office, invoice those clients for IPC annual membership.

So for them, it's all win-win.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

+1 That's why they have been able to move from some tatty backstreet office to plush ones in a very expensive golf club.

Perhaps the IPC members should check out the cars parked there now.

    ‘Clean up the parking industry’?

As Jim Royle would say ‘Clean up my !!!!!!’! :rotfl:
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

according to the report on here and PP "Gladstones failed to pay the hearing fee or send in any evidence meaning that the claim was struck out."

as the parking co hired gladrags to see this thru , and they failed to do the basic paperwork and send payment , are they not liable for the loses?

It depends on how their contract with the PPC is constructed. e.g. perhaps the PPC is responsible for making court fee payments. ;)

If this happened to me I would lob in a huge complaint to the SRA.
