Quidco small claims?

Hi

Has anyone tried taking Quidco to the small claims court and if so were they sucessful?

My issue relates to a purchase 18 months ago where they paid out at a lower level than advertised. I have been chasing the difference for 12 months now and just get a generic response each time.

Even the retailer has raised a complaint on my behalf and Quidco are not replying to them either.

I know burried in their terms they might say cashback is not guarenteed but surely this would be considered an unfair contract term and disregarded by the courts?

I have moved onto using TopCashBack who are much more competent in resolving long standing issues so I am happy to burn my bridges with Quidco in forcibly recovering the debt.

    Look on the topcashback thread on shop don't drop , someone on there has experience of using the FCA and possibly small claims court

    Yup tried that and still not getting a human response. I have just emailed their complaints department again saying if is not resolved by 11th Nov then I will take them to court. See if that gets a reply but I am not hopeful.

    Quidco are registered with the FCA for insurance services, so may be helpful if that was the product in question.

    I can't find any successful small claims cases. The only one I spotted (Arsenal) states they won actually settled for half the amount they had claimed, so no case heard and not really a win.

    I've not searched further, could you provide OP with some relevant cases please?

    It was a telecoms product. The annoying thing is that if someone at Quidco looked into my case then I think they would agree that a mistake has clearly occured. The problem is that I have no way of talking to a human. I suspect the answers I have received so far over the past 12 months are entirely automatic.
  • Is it worth your while upgrading to a premium account. You then get livechat/callbacks.

    I kinda resent paying them to resolve an error in their domain. I don't intend to use them again so just want the debt settled.
  • Must admit I've lost all faith in quidco - just waiting to get a large cash back amount & then I'm off as well.

    Woo my deadline to take them to small claims court has worked and a human just emailed me to arrange urgent payment!
