Hi all,
I am currently drafting a response to a PCN at County Court on the basis that it is not compliant with POFA 2012.
I am using paragraph 9 as part as they can prove what time my vehicle entered and exited the car park, although the number plate is patently unreadable on the inward picture, but not how long I was actually parked for.
This got me thinking, the signage states that you can park for 4 hours for free, but offers no option of making any recompense to stay longer if needed. If there is no way of paying for extra time if needed, are Civil Enforcement entrapping the motorist who may get caught in an unexpected queue for example?

the beavis case 2 years ago was a similar car park , he lost due to an overstay
I suggest you remove any hint of who was driving
the driver "parked"
if this is at county court stage , its an MCOL you are defending
the BPA CoP defines the grace periods allowed and CEL signed up to the BPA AOS on that basis0 -

It was a 20 min overstay. I'm confused by the acronyms RE grace periods - can I get it in simple language please? What exactly did CEL sign up to?
I'm going with defense of:
1. Can't read number plate on entry picture
2. Can't prove how long the car was parked
3. No way to avoid overstay charges if stuck
4. Registered keeper not liable as pcn issued waay after 14days by post.0 -

That's not a CEL defence as per those advised by this forum. Read other CEL threads and find a decent defence already written only this week.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
